TERMS AND CONDITIONS OF SERVICE Fort Myers Area HVAC Services — Serving Southwest Florida Effective Date: January 1, 2026


1. Agreement to Terms

By accessing our website, requesting a quote, scheduling a service appointment, or engaging our heating, ventilation, and air conditioning (HVAC) services, you ("Customer" or "you") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and [Company Name] ("Company," "we," "us," or "our"), a licensed HVAC contractor operating in Lee County and surrounding Southwest Florida counties.

If you do not agree with any part of these Terms, please do not use our website or services. We reserve the right to update these Terms at any time, and continued use of our services constitutes acceptance of any revised Terms.


2. Scope of Services

We provide residential and commercial HVAC services in the Fort Myers, Cape Coral, Bonita Springs, Naples, and surrounding Southwest Florida areas, including but not limited to:

  • Installation of new HVAC systems, air handlers, heat pumps, and ductwork
  • Repair and maintenance of existing heating and cooling systems
  • Indoor air quality assessments and equipment installation
  • Emergency HVAC repair services
  • Preventative maintenance plans and service agreements
  • Thermostat installation and smart home HVAC integration
  • Duct cleaning, sealing, and replacement

All services are subject to availability and technician scheduling. We reserve the right to decline any service request that falls outside our scope of expertise, poses a safety hazard, or violates applicable building codes or regulations.


3. Estimates, Pricing, and Payment

3.1 Estimates Written estimates are valid for thirty (30) days from the date of issuance unless otherwise stated. Estimates are based on conditions observed at the time of assessment and may be adjusted if additional issues are discovered during service. We will notify you of any material changes before proceeding with additional work.

3.2 Pricing Our pricing includes labor, standard materials, and applicable fees unless otherwise itemized. Prices for parts and equipment are subject to change based on manufacturer pricing and availability. Florida state sales tax will be applied to parts, materials, and taxable services as required by Florida law.

3.3 Payment Terms

  • Payment is due upon completion of service unless prior arrangements have been made in writing.
  • We accept major credit cards, debit cards, checks, and electronic payments.
  • A deposit of up to 50% may be required for new installations or large equipment orders.
  • Invoices not paid within 30 days are subject to a late fee of 1.5% per month on the outstanding balance.
  • Returned checks are subject to a $35 returned check fee.

4. Appointments and Scheduling

Service appointments are scheduled based on technician availability. While we make every effort to arrive within the agreed service window, arrival times may be affected by prior job complexity, traffic, weather, or other unforeseen circumstances. We will make reasonable efforts to notify you of any significant delays.

Cancellations must be made at least 24 hours prior to the scheduled appointment. Cancellations made less than 24 hours in advance may be subject to a service call fee. We reserve the right to reschedule appointments due to extreme weather, technician emergencies, or other circumstances outside our control.


5. Customer Responsibilities

To ensure safe and efficient service, you agree to:

  • Provide safe, clear, and reasonable access to the HVAC equipment, electrical panels, and related areas requiring service.
  • Ensure that pets are secured away from work areas.
  • Disclose any known hazards, pre-existing conditions, or prior repairs relevant to the service requested.
  • Ensure an adult (18 years or older) is present on the premises during service visits.
  • Maintain the HVAC system in accordance with manufacturer recommendations and any instructions provided by our technicians.
  • Obtain any required homeowner association (HOA) approvals prior to equipment installation.

6. Warranty and Guarantees

6.1 Labor Warranty We warrant our labor and workmanship for a period of one (1) year from the date of service completion. This warranty covers defects in workmanship directly attributable to our installation or repair work. It does not cover issues arising from customer misuse, normal wear and tear, power surges, acts of nature, or pre-existing conditions.

6.2 Equipment and Parts Warranty New equipment and parts are covered by the respective manufacturer's warranty. We will assist in facilitating warranty claims on your behalf but are not responsible for honoring manufacturer warranties beyond our role as an authorized installer or service provider. Please retain all warranty documentation provided at the time of installation.

6.3 Warranty Exclusions Warranties are void if:

  • The equipment has been serviced, modified, or repaired by an unauthorized third party.
  • The system has been damaged by flooding, lightning, fire, pest infestation, or other external causes.
  • Recommended maintenance has not been performed.
  • Non-approved parts or refrigerants have been used.

7. Limitation of Liability

To the fullest extent permitted by Florida law, the Company's liability for any claim arising out of services rendered shall be limited to the total amount paid by the Customer for the specific service giving rise to the claim. In no event shall the Company be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of profits, property damage caused by pre-existing conditions, or personal injury not directly caused by our negligence.

We are not liable for equipment failure resulting from power fluctuations, inadequate electrical service, improper installation of systems not completed by us, or damage caused by failure of the customer to follow maintenance recommendations.


8. Florida Regulatory Compliance

All HVAC services are performed in accordance with applicable Florida Building Code requirements, Florida Statute Chapter 489, and Lee County and surrounding local jurisdiction ordinances. Where required by law, permits will be obtained by the Company and associated permit fees will be included in the project estimate or invoiced separately.

We are licensed by the Florida Department of Business and Professional Regulation (DBPR). Our license number will be provided upon request and is displayed on all formal contracts and invoices. We carry general liability insurance and workers' compensation coverage as required by the State of Florida.

Florida law provides certain rights to consumers of contractor services. Nothing in these Terms is intended to limit any rights provided to you under Florida Statute §718, §553, or other applicable consumer protection statutes.


9. Refrigerant Handling

All refrigerant handling is performed by EPA Section 608 certified technicians in compliance with federal and Florida environmental regulations. We do not release refrigerants into the atmosphere. Refrigerant recovery, reclaim, and disposal costs may be itemized separately on your invoice. We do not service systems using prohibited or discontinued refrigerants that cannot be legally recharged or repaired.


10. Website Use and Online Bookings

Our website is provided for informational and transactional purposes. By using our website, you agree not to:

  • Submit false or misleading information in forms or booking requests.
  • Attempt to gain unauthorized access to any portion of the website.
  • Use the website for any unlawful purpose or in violation of applicable laws.

Online quote requests and service bookings made through our website are subject to confirmation by our office. Submission of a booking form does not guarantee appointment availability. We will contact you within one (1) business day to confirm scheduling.

14. Indemnification

You agree to indemnify and hold harmless the Company, its owners, employees, and subcontractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to: (a) your breach of these Terms; (b) your failure to provide accurate information or safe access; (c) damage caused by pre-existing conditions you were aware of but did not disclose; or (d) your misuse of installed equipment.


15. Modifications to Terms
